When buying in San Miguel, it is important that you ensure a smooth transaction. As such, there is one person who is at the forefront of importance when dealing with this aspect of becoming a home or property owner in Mexico. The Notario is the most important person you will be dealing with when you make your decision to buy in San Miguel. The Notario is very different from the Notary Public in the US. In Mexico, the Notario is a position that is directly appointed by the State Governor, the highest seat in the State Public Office, making this position much more difficult to attain in Mexico than in the US. In the US, almost anyone can apply to be a Notary Public, but that is not the case in Mexico. In fact, in order to even be considered as a Notario in Mexico, a person must be Mexican, and at least 35 years old. The person must have a law degree, three years of work experience at a Notario office, and must pass a stringent exam. Those who pass may in time be appointed by the government as a Notario. The Role of the Notario in Real Estate Transactions The actual job of the Notario is to witness and certify important business documents that require authenticity, such as your property purchase in Mexico. A Notario takes the place of the traditional escrow or title insurance company, preparing all documents related to the purchase of your property. Highly experienced and specialized in this and other aspects of law and real estate in Mexico, the Notorio oversees property transfers and other legal matters. The Notorio Publico will also handle the complete transaction including title search, property transfer and other details related to your purchase. According to Mexican Law, your property deed MUST be prepared only by a Notario. As the purchaser, you have the right to choose which Notario you use for the preparation of your deed, but be sure to discuss your decision with your REALTOR® or lawyer as well. Also, ensure that you have the deed double checked to ensure its accuracy in order to further ensure a smooth transaction. Make sure that your Mexican property purchase is a pleasant experience.
